Right to Know Policy

The Borough of Emmaus is a public agency and subject to the provisions of the Pennsylvania Right to Know Act. The Borough of Emmaus has established a "Right to Know" policy in conformance with the act. The Borough of Emmaus Police Department recognizes that certain information is public record and, as such, may be released to the public in a manner that does not compromise the effectiveness or operations of the agency and accordance with the borough's policy.  The Borough of Emmaus Police Department also recognizes that it is not obligated to keep or create separate data bases to comply with the provisions of the act. It shall be the policy of the Borough of Emmaus Police Department to comply with the Borough of Emmaus Right to Know policy and appeals as specified. 

The Chief of Police  shall serve as the primary Open Records Officer for the Borough of Emmaus Police Department, 610-967-3113.

Requests

For all records request with the Borough of Emmaus Police Department, please use the Standard Right to Know Request Form (PDF)

Open records request can be submitted to the Chief of Police via email police@emmauspd.org, or in person or mail to 400 Jubilee Street Emmaus, PA 18049.

All request forms must be completed including name, address and a clear description of information being requested.

Important Notice: Under the Right to Know Law, Investigative Reports (i.e. incident reports and police reports) are exempt from the definition of a "public record." Therefore, any such request may be denied. For more information please view Pennsylvania Right to Know Law section 708 (16ii) and (17ii).

Responses

The Chief of Police shall review all right to know requests and respond in no later than five (5) business days of receiving such request in accordance with the Borough of Emmaus Right to know Police.

Fees will be charged in accordance with the Borough of Emmaus Right to Know Policy and the Pennsylvania Right to Know Law section 1307.
